First it's important to note that over years I realized that #OSI is just a corporate (and US-led) gatekeeper organization that serve the very interests their sponsors.
You can easily see this reading their license review mailing while keeping a tab opened on the sponsors page of the day through the #WaybackMachine.
Just as a couple of example, they rejected #MongoDB's #SSPL while #Amazon was their major sponsor and adopted CAL that was way more contentious.

The last damage that OSI did to our communities has been the #Meta dictated #OSAID (OpenSource #AI Definition) better known as #OpenWashing Definition, that superseed the #OSD and does not require training data sharing, voiding the freedom to study and welcoming toxic candies within "open source" just to avoid the #AIAct requirements.

So I don't care about OSI opinion about the #HackingLicense (or about anything else).

Having said that, you are right that its first condition forbid any use of the covered work that would limit third party access or use of it.

So basically you can't use your freedom to limit the freedom of others.

Is it still a free license?
Never asked to #RMS or #FSF, but I guess that such formal constraint makes it "not free" to their eyes.

What they miss, imho, is that freedom without communion is always going to be exploited by the strongers (under #capitalism, the rich) to oppress the weakest (everybody else, the workers, the customers, the environment...) as #LLM are showing these days.

In fact the latest version of the #HackingLicense was written in response ti #GitHub #Copilot (aka #CopyALot), after it distributed #GPLv3 code from #Quake with a wrong attribution and a permissive license.

The Hacking License is a dependency inversion: if you use data or code covered by it, anything that come out can be used under such license.

The EU's call for input on its Open Digital Ecosystem strategy got over 1600 responses, one of the highest numbers ever received.

#OSI's ED, Deb Bryant is now talking, "The best way to extract value from Open Source is to participate in it", says Deb.

Deb also highlights the financing challenges, in particular given layoffs in OSPOs at corporations who previously contributed significantly to Open Source projects, and highlights the need for changes in procurement to incentivise participation!

I read the statement as an admission of error (in political speak). #OSI's by-laws created a self-perpetuating Board, & it has never been any different: elections were advisory, not binding.

This was the root cause of all the problems: folks hear “election” & think “my vote COUNTS!”. But it never did.

What's missing is remedy for the past. What happened in March 2025 mattered, & Step 0 is remedy for that. Doing the rest of what they propose as Step 1-N seems fine to me.

BTW, do see downthread where @jzb & I discuss recent news (like, today) about #OSI Elections being suspended for 2026.

While I literally had a door-to-door 24 hour travel cycle to get to #FOSDEM, I had not seen OSI's announcement when I wrote the above, but having caught up, it's all the more reason for folks to *sign the petition*. OSI is saying they want input from stakeholders about what happened & what to do next. You're the stakeholders; say so by singing:

As a former elected Board member, I support this 100%. One problem with an elected Board is that it doesn't assure that the needed competencies are available at the Board level. Over time the OSI added more and more appointed Board members to address this problem, but it is time to reconsider the full process #FOSS #OSI #OpenSource #HealthyCommunities

Layer 7 - Application: Enables user-facing applications (browsers, email) to access network services.
Layer 6 - Presentation: Translates, encrypts, and compresses data for the application layer to use.
Layer 5 - Session: Manages sessions (connections) between applications, handling authentication and reconnection.

@webvision Die Annahmen wie Open Source mehrheitlich funktionieren würde darin mal jetzt nicht in Frage stellend, allerdings einige Fragen und Anmerkungen:

  • Wie ist "Gemeinnütziges Open Source" von solchem zu trennen dass diese Eigenschaft nicht erfüllt?
    • Was ist mit solchem die einem offen/kommerziell Modell folgen wie die klassische GPL/Kommerziell Trennung oder solchen für die ab bestimmten Anfragegrößen kommerzielle Wartungs/Entwicklungsabkommen geschlossen werden und sonst kleinere Dinge unentgeltlich oder gegen Spenden erledigt werden?
  • Ab welchem Anteil Kontrolle und Eigentum über die gesamte IP des Werkes sollen die Effekte für die jeweiligen deutschen Maintainer greifen? Oder jede Zeile die in jedes Projekt upstream durch Maintainer in Deutschland gegangen ist, ist golden&steuerlich abgedeckt?
    • Wie sieht es mit von nicht-deutschen Contributions geprägten Projekten mit in Deutschland lebenden Maintainern aus?
    • Wie wird "der Vereinsvorstand" aus einem internationalen Kreis an Maintainern bestimmt für die Haftung? Gilt die dann auch für einen nicht in Deutschland befindlichen "Maintainer vom Dienst"? Oder hofft man dann auf das Greifen der Haftungsausschlüsse?
    • Wollen wir jedem Projekt dann die Notwendigkeit von Impressumspflicht usw usf überhelfen?
  • Wie sieht es mit dual-use fähigen Projekten aus die letztlich gegen das eigene Land eingesetzt werden können?
  • Die Übungsleiterpauschale ist mit 3300€/Jahr anzusetzen. Das ist überschaubar viel. Danach dann zwingendes Finden von 7 Menschen für einen Verein oder Zusammenrottung zu FOSS-Kollektiven um den Bürokratie-Overhead durch Sharing zu reduzieren, quasi die #FOSS-LPG?
  • Das wiederholt geäußerte Problem ist die fehlende Entlohnung/Bereitstellung vergüteter/freier Zeit für als relevant empfundene Open Source Werke. Wie wäre es damit den bei Organisationen in der Regel mit zunehmender Größe und zunehmendem Alter recht stark ausgeprägten Überlebenswillen zu nutzen? Hierfür konnte man die Haftungsfreistellungen in den gängigen #OSI-Lizenzen für in Deutschland vollständig gültig und durchsetzbar erklären, sowie die ohnehin existente und zunehmend an anderen Stellen weiter gestärkte Haftung der kommerziellen Einsetzer für die durch sie eingesetzten FOSS Komponenten nutzen. Dies trifft hier natürlich insbesondere auch öffentliche oder schein-öffentliche Organisationen. In der Regel dürfte hier nach wenigen Treffern ausreichender Größe ein Umdenken einsetzen was in aller Regel zur Bereitstellung von Arbeitsleistung für häufig eingesetzte Projekte oder solchen, die als risikohaltig oder geschäftskritisch wahrgenommen werden, führen dürfte. Insbesondere der Rückgriff auf die Versorgungskette durch die Köpfe der Wertschöpfungskette dürfte hier massiv zur Skalierung der gewünschten Effekte beitragen. Derartige Effekte können bereits jetzt im Markt beobachtet werden.#markt #UnsichtbareHandDesMarktes
