I'm at a celebration of #MLK at the University of Houston.
One of the panelists (sorry, I had to sit in the back, so I don't know who) talked about #risk.
This is in relation to the #redemption that comes from #suffering.
There is #truth in this. I'm old. But the three times I felt something almost #holy was when I risked.
The first time. . .
After my sister changed her major to Women's Studies, she volunteered to be #security at the local #Pride #Parade. I did the training with her. Basically, we were part of a wall of bodies between the parade and the crowd. At one point, there was.a woman yelling and screaming about the Bible, and as I stood in front of her, I didn't even hear her. I felt this deep abiding #calm. I'm not a #believer, but if I were, I would describe it as some kind of divine Presence.
The second time. . .
A coworker was going to the drugstore down the street to get baseball cards, and while I walked down with him, I mentioned that I was treated better at work than at home. He asked me, "What are you going to do about it?" The same calm came to me as I realized I could leave. It was so powerful I went back to work and told my boss that I was feeling weird and I thought I needed to go home. Which I did. I moved in with my sister until I found an apartment.
The third time. . .
I had been working for about thre months when the staffing agency that all of the staff was contracted through wac bought by a bigger agency that mostly staffed the #defense #industry. Instead of #HR, they sent #attorneys. They pulled some shenanigans, but my coworkers in California didn't have to sign #nonCompete #agreements. So they allowed the rest of us to opt out. They even allowed us to jump to a different staffing agency that had profit-sharing. Except the #BigTech we worked for was slow-walkimg the paperwork for the four who were trying to do it. I very carefully set up my remaining PTO and was in another state when my final dey rolled around. Unlike the other four, my role was support. They could survive without me until the paperwork was ready. And, when my boss called and asked if I was not going to work, I felt that calm when I said that I wasn't going to work if I wasn't going to be paid.
In two weeks, all of our paperwork went through, so we all had the same hire date.

Well, I’m done with the Chamber of Commerce.
When I moved from Seattle, Washington to Lincoln City, Oregon, I did a couple of business related things: I re-licensed my business in Oregon, and I joined the Lincoln City Chamber of Commerce as a way of getting known in the community. A couple of years later when I moved back to the Seattle area, I thought, “I should probably join the Chamber here,” but I never did. And now I’m glad I didn’t re-associate with the Chamber, because I just randomly learned something: the US Chamber of Commerce (of which the local Chambers are members) opposed the FTC’s rule banning non-compete agreements.
To hell with non-compete agreements.
The last time I signed a non-compete agreement was in 1983. When I left that company 12 years later I had to hire an attorney to advise me about my next job. It turned out the non-compete clause was toothless, but I had to pay money to find that out. I made the decision then that I’d never sign another non-compete. They were placed in front of me, mind you, as part of the on-boarding process, but I always politely said, “I don’t sign non-competes,” and THEY HIRED ME ANYWAY.
I never lost a job by refusing to sign a non-compete. (Your mileage may vary).
And now that I know the US Chamber of Commerce is in favor of companies having the right to enforce non-compete agreements, I don’t want to be affiliated with them.
I reserve the right to work anywhere, anytime, for anyone. It’s my life, not yours. I sign non-disclosure agreements all the time, but non-competes, never. You can keep your secrets – but my knowledge, experience, and skills are mine, and fully transferable.
TL;DW -- the capitalists control the messaging, kings and capitalists take credit for the workers that build their mythical statuses.

И вдруг решаете сменить работу, чтобы расти дальше и идти в ногу со временем. Но тут сюрприз – ваш контракт запрещает вам делать то, что вы умеете лучше всего. Как так?
Недавняя новость о сотрудниках Google DeepMind в Великобритании, которым, как оказалось, после увольнения запрещается год работать на конкурентов – отличный повод поговорить о том, почему контракты «non-compete» – это, мягко говоря, очень плохая идея. И не просто плохая, а бесчеловечная и противоречащая базовым принципам свободы.
Что такое non-compete? Это договор, согласно которому вы, уходя из компании, обязуетесь не работать у её конкурентов какое-то время. Мало того, вам в это время могут продолжать платить зарплату. Звучит почти мечтательно, правда? Но не всё так просто. Фактически, вас отправляют в «золотую клетку»: зарплату платят, но профессионально вы деградируете. Особенно в быстро меняющихся отраслях вроде ИТ и ИИ, где год простоя может стоить карьеры.
Почему это неприемлемо с точки зрения либертарианства? Главная ценность либертарианской философии – личная свобода и право собственности на самого себя. Когда работодатель ограничивает вашу свободу заниматься любимым делом, он покушается на ваше фундаментальное право – распоряжаться собственным трудом и талантами. Кроме того, данные контракты противоречат универсальным правам человека. Они идут вразрез с базовыми гуманистическими принципами, ограничивая свободу и принуждая талантливых людей либо «сидеть на лавке», либо уходить в другую сферу, теряя навыки и мотивацию.
Хорошие новости – далеко не все суды поддерживают такие соглашения. Например, в США Верховный суд Калифорнии уже давно признал большинство договоров non-compete незаконными, потому что они «несправедливо ограничивают возможность гражданина зарабатывать на жизнь». В 2021 году Верховный суд Иллинойса отказался признавать non-compete для работников ресторанов, посчитав, что нет справедливых оснований запрещать официантам переходить в конкурирующие заведения.
Другие примеры бесчеловечных контрактов:
– В 2017 году британский суд признал незаконным контракт, запрещающий медсёстрам увольняться из государственной больницы и переходить в частные клиники – суд посчитал это посягательством на свободу труда.
– Американский суд отменил соглашения, по которым сотрудники Amazon были обязаны возмещать расходы на обучение компании, если увольнялись раньше срока – это было признано формой долгового рабства.
– В 2019 году немецкий суд отменил контракт футбольного клуба, запрещавший игроку в случае ухода выступать за клубы-конкуренты в той же лиге. Судья аргументировал: «Человек – не товар».
Почему это важно сейчас? Мир меняется стремительно. Искусственный интеллект, блокчейн, биотехнологии – эти индустрии развиваются настолько быстро, что потеря даже нескольких месяцев может обернуться полной профессиональной несостоятельностью. Неужели мы готовы допустить, чтобы корпорации контролировали не только наше настоящее, но и будущее, диктуя, где и кем нам можно работать завтра?
Либертарианский взгляд шире: свобода договора – это хорошо, но свобода не должна превращаться в цепи. Ведь свобода контракта заканчивается там, где начинается ограничение фундаментальных прав человека. Нельзя продавать или покупать право на чьё-то будущее! И несогласные с этим авторитарии, готовые насильно навязывать подобный порядок другим, должны понимать, что отказ от универсальных прав человека неизбежно сработает и в их сторону, например, отказом от невмешательства в их нервную систему без согласия, который сейчас воспринимается как данность, но вообще-то является чьей-то доброй волей и желанием соблюдать конвенции, а не законами физики.
Давайте помнить: люди – не ресурсы. Талант – не собственность компании. А свобода человека распоряжаться своей жизнью и карьерой – это святое.

Is this legal? 1935 #SupremeCourt case, #HumphreysExecutor v. #US, may come into play here. Court ruled FTC commissioners could be removed for "inefficiency, neglect of duty, or malfeasance in office." The first two could be twisted to apply to anyone the #President doesn't like or want.
