Court orders Trader Joe's to pay workers' union $112,622.12 in attorneys' fees for defending against the "exceptionally weak" trademark lawsuit:

"Employers should be discouraged from bringing meritless claims against unions they are challenging at the ballot box."

scribd.com/document/728641895/

The Motion is granted. In dismissing Trader Joeโ€™s Complaint, the Court concluded that the
present action related to an existing labor dispute and lacked merit because no reasonable consumer
could plausibly be confused as to the source of the Unionโ€™s labor-themed and visually distinct
merchandise. For those reasons, the present action is considered exceptional under the Lanham Act
because it โ€œstands outโ€ in terms of its lack of substantive merit and the manner in which the case was
litigated. SunEarth, Inc. v. Sun Earth Solar Power Co., 839 F.3d 1179, 1181 (9th Cir. 2016)
(quoting Octane Fitness, LLC v. ICON Health & Fitness, Inc., 572 U.S. 545, 554 (2014)). The
Court therefore awards attorneysโ€™ fees to the Union in the amount of $112,622.12.
