Die Aufrechterhaltung eines jüdischen Staates ist eine politische Präferenz, die nicht über die grundlegenden Rechte eines ganzen Volkes gestellt werden kann. Das Rückkehrrecht ist nach internationalem Recht ein fundamentales Recht. Ob man diese Behauptung als Nebelkerze betrachtet, hängt davon ab, welche Zukunftsvision von der Region man hat. Wenn die Vision darauf abzielt, die Vorherrschaft jüdischer Israelis über Palästinenserinnen und Palästinenser zu zementieren, dann ja: In dem Fall stellt das Rückkehrrecht das infrage.
In der Menschenrechtsbewegung besteht heute Konsens darüber, dass wir es mit einem Apartheidregime zu tun haben. Die Abschaffung dieses Apartheidregimes ist entscheidend für die Verwirklichung der grundlegenden Rechte aller Menschen, die dort leben. Ohne die Anerkennung des Rückkehrrechts ist das nicht möglich. Sobald diese grundlegenden Rechte anerkannt sind, werden viele politische Konstellationen denkbar. Was nicht geht, ist eine fortgesetzte Verweigerung von Rechten, um eine politische Präferenz zu bewahren.

Deux cadres de Human Rights Watch (HRW), Omar Shakir et Milena Ansari, ont démissionné après que la direction de l'association ait bloqué leur rapport déclarant que le refus d'Israël de respecter le droit au retour des réfugiés palestiniens constitue un "crime contre l'humanité".
Le rapport, qui documente le vécu des réfugiés déplacés depuis 1948, mentionne que l'interdiction de retour constitue un crime défini par la CPI dans la catégorie "autres actes inhumains".
Shakir et Ansari ont déclaré que la direction avait fait passer sa peur d'affrontements politiques devant les principes juridiques limitant par là la portée du rapport aux seuls déplacés récents, compromettant ainsi l'intégrité de HRW.
Plus de 200 salariés ont protesté contre le retard quand HRW a affirmé que le rapport devait être "examiné plus profondément". Ces démissions ont provoqué un débat sur la crédibilité de HRW, en particulier quant à son traitement du respect des droits de l'homme en Palestine.
